What changed on 18 September 2026
On 18 September 2026, TRAI notified the Telecom Commercial Communications Customer Preference (Third Amendment) Regulations, 2026, the latest update to the TCCCPR 2018 framework that governs commercial calls and SMS in India.
The parts that matter for AI calling:
- AI calls now have a name. The amendment defines Application-to-Person (A2P) calls as calls initiated by an application or automated platform, explicitly covering autodialled calls, robocalls and artificial-voice calls. A live conversational AI agent falls in this category, just like a recorded robocall.
- You must declare A2P calling in advance. Entities making A2P calls must pre-declare that use to their telecom service provider, along with the Calling Line Identities (CLIs) they'll use. Declarations are recorded on the industry's shared DLT platform.
- Undeclared AI calls are treated as spam. They are handled as unsolicited commercial communication (UCC). The amendment also provides for a per-minute termination charge of up to ₹0.05 on A2P traffic, subject to its exemptions.
- Detection is now AI-driven too. Telecom operators must use AI/ML to flag CLIs likely to be sending spam and share that intelligence with each other.
- Complaint thresholds are tighter. Action can be triggered when 3 or more unique complaints within 10 days coincide with AI detection flagging the sender. Escalations include KYC re-verification, barring of outgoing services and disconnection.
- Legacy consent can count. Consents you already hold can be recognised if they're registered on the operators' consent platforms.
Timelines are phased. Industry summaries describe roughly 30, 60 and 90-day windows for different provisions, with the declaration duty among the later ones. The rules that already applied (and still do)
The amendment adds to the existing framework. AI calls still have to meet everything a human telemarketer does.

Using an ordinary 10-digit mobile number for commercial calling is not allowed. TRAI treats such senders as unregistered telemarketers.
2. Register on DLT
Your business, as the principal entity, registers on a DLT platform, and your headers and content templates are registered there.
3. Respect consent and DND
- Promotional calls need the customer's consent or must respect their registered preferences on the NCPR (Do Not Disturb) registry.
- Service and transactional calls must relate to an existing relationship or transaction.
- Keep proof of consent: when, where and for what.
4. Handle personal data properly
India's Digital Personal Data Protection Act, 2023 (DPDP) applies to the phone numbers and call recordings you process. Collect consent for a specific purpose, store data securely and honour deletion and opt-out requests.
5. Disclose that it's an AI (best practice)
The amendment doesn't spell out an in-call AI disclosure. Still, opening with "I'm an AI assistant calling from [Business]" builds trust, reduces complaints, and with a 3-complaint threshold, fewer complaints really matters.

Is calling on WhatsApp different?
Yes. Calls made through the WhatsApp Business Calling API run over the internet inside WhatsApp, not over the telecom voice network. WhatsApp is an over-the-top (OTT) service, and TRAI's DLT and number-series framework is built around telecom networks, so WhatsApp calls aren't placed from 140 or 160-series numbers.
That doesn't make them a free-for-all:
- Meta's policies apply. Customers must have opted in, and businesses that spam get restricted or banned.
- DPDP still applies to the personal data involved.
- Customers can block or report you in one tap.
For many SMB use cases, such as calling back a lead who messaged you on WhatsApp or confirming a booking, a WhatsApp call to an opted-in customer is the cleaner route. Confirm your specific setup with your advisers.
